General booking conditions for pedal-assisted bicycle rental

1. E-bike booking procedure

The site www.ebiketravel.it it is up and running (except for technical problems) 24 hours a day, 365 days a year and therefore the User will be able to make their e-bike reservations there at any time.

To complete the booking of the e-bikes, the User must follow an electronic procedure, described below:

  • choose the “E-BIKE TRAVEL Shop” where you intend to rent;
  • click on the “RENT YOUR E-BIKE” button;
  • fill in all the fields of the "Rental Form".

To confirm the rental booking, the User must accept these "General Conditions", declaring that they have read them, fully understood and accepted them fully and unconditionally.

The User will also be asked to read the information relating to the processing of his personal data pursuant to Legislative Decree no. 30 June 2003. 196 and subsequent amendments, and to authorize the processing of such personal data, freely provided, for the purposes relating to the provision of the service and, optionally, for any other purposes, described in detail.

2. Conclusion of the contract

At the end of the booking procedure of the e-bike(s), the User will receive an email confirming that his booking request has been "taken over" by the "E-BIKE TRAVEL Store" concerned.

This email does not represent an acceptance of the booking but only a declaration of "taking charge" of the aforementioned booking.

The "E-BIKE TRAVEL Shop" may not accept the booking request received from the User in the event of unavailability of the requested e-bike(s).

In case of non-acceptance of the booking, the "Shop" will promptly inform the User, offering, if possible, an alternative e-bike available even if in a different type or size than what the User requested.

If the User does not intend to accept any alternative proposals or if it is not possible for the "Store" to propose alternative proposals, the "Store" will immediately refund the amount advanced by the User, excluding the User from requesting compensation for damages or compensation. , for any reason, for failure to confirm the booking.

3. Description of the products

All information published on the site, relating to the characteristics of the products on sale (textual descriptions, photos, drawings, etc.), are provided by the producers of said products or created directly by the "Shop", which reserves the right to make all the changes it deems appropriate to improve the quality of the information provided, without any prior notice obligation.

4. Prices

All rental e-bike prices are expressed in Euros.

The "Shop" reserves the right to change prices at any time without notice, but undertakes equally to apply the prices indicated on the site at the time of booking the rental.

5. Payment methods

Payment for rented e-bikes includes:

  • the payment of a deposit of a variable amount and in any case decided by each individual "Shop", by credit card (processed via Stripe), at the time of booking from the "E-BIKE TRAVEL" website;
  • payment of the balance upon collection of the e-bike, by credit card or in cash.

6. Responsibility

The "Store" assumes no responsibility for disservices attributable to force majeure which prevented, in whole or in part, from executing, in the agreed ways and times, the rental booked by the "Users".

The "Shop" is in no way responsible for any damages, losses and/or costs suffered by the "Users" resulting from the failure to carry out the rental, without prejudice to the right of the "Users" to the refund of the amount paid.

The "Store" reserves the right to suspend, modify, or interrupt the online rental service, for technical or other organizational reasons.

As regards responsibilities directly linked to the rental of bicycles, please refer to the contents of the "Rental Agreement" and the related "General Rental Conditions" which Users must sign before collecting the bicycles.

7. Processing of Personal Data, “Privacy” and Cookies

The "Shop" will process all personal data provided by the "Users" at the time of registration in full compliance with the provisions contained in Legislative Decree no. 30 June 2003, n. 196, according to the methods and for the purposes indicated in the information provided to the User pursuant to art. 13 of the Code.

Having read the information pursuant to art. 13 of Legislative Decree no. 196/2003 and by having read and implicitly accepted these "General Conditions", the "Users" express their express consent to the processing and communication of data concerning them.

8. Applicable law and competent court

The law applicable to these "General Conditions of Sale" is Italian law.

For civil disputes relating to the application of this contract, the mandatory territorial jurisdiction lies with the judge of the place of residence or domicile of the Consumer (pursuant to article 18 of Legislative Decree no. 206/2005).

For civil disputes against those who are not attributable to the figure of Consumer (pursuant to article 18 of Legislative Decree no. 206/2005), i.e. those who carry out commercial, industrial, artisanal or professional activities, the rules of the Code of Civil Procedure will apply.
